I-9 form is a kind of forms issued by USCIS to verify both the identity and employment eligibility of people recruited to work in the United States. An employer must verify that person’s legal eligibility in the United States while hiring a new employee. Form I-9 is a must for every employee who wants to work in the USA. Part I: Creating an Identity for the Employee

The employee fills this section. It includes information such as the employee’s full name, address, date of birth, Social Security number, email address, and phone number. The employee must sign and date the form. False statements can result in fines and/or imprisonment. Some employees may need help completing parts of the form.

Part II: For the Employer, Examining the Employee’s Documents

The employer fills out this part of the form. It explains the documents that the employer has reviewed to verify the eligibility of employment. The employer has to do this within three days from the first day of employment. The employer may make a copy of the documents submitted, but is not required. There are three document lists that can be used. The type of documents used determines the part of Part II that the employer must fill.

List A: The documents in this list identify both the employee’s identity and employment authorization. An employee must submit only one of the following forms to meet the document requirement:

US passport (or US passport code)
Permanent resident card (“green card”) or foreign registration certificate.
Foreign passport with temporary I-551 stamp
Work authorization document with photograph (Form I-766)
For a non-immigrant alien with a work permit: a foreign passport and Form I-94 (or 94A) and confirmation of the foreigner’s non-immigrant status unless it has expired

List B: The documents in this list show the employee’s identity. If an employee does not have a document from List A, a document from List B is required, as well as a document from List C.

A state-issued driver’s license or ID card. This document must include photographs and personal documents.

US military card or draft record,
Military dependent identity card,
US Coast Guard Merchant Marine card,
Native American tribal certificate,
Driver’s license issued by a Canadian government official.

List C: This document specifies the employee’s authorization to work in the United States.

Social Security account number card
Certificate of birth abroad issued by the Department of State (Form FS-545)
Birth certificate certificate issued by the State Department (Form DS-1350)
Original or certified copy of an official stamped birth certificate issued by a U.S. state, county, municipal authority, or territory
Identity Card (Form I-179) for use by a citizen residing in the United States
Employment authorization certificate issued by the Ministry of Homeland Security

Part III: For Employer, During Rehiring

This part of the form is also filled in only by the employer, but is used only in case of re-verification when rehiring the employee. If the employer rehires within three years of the original I-9 date, the employer may choose to complete this section or a new Form I-9.
